Jenner & Block won a victory for client Sharp Electronics when a judge dismissed a putative class action accusing Sharp of falsely marketing its line of flat screen televisions as “LED TVs.” US District Judge William J. Martini said that every side of the box containing the televisions in question states that the product is both an “LED TV” and a “liquid crystal television,” so a reasonable consumer could not be deceived. The Court allowed the plaintiffs 30 days to file an amended complaint to attempt to address the deficiencies identified in Sharp’s motion to dismiss and noted by the Court.
