Firm Secures More Than $85 Million for Client Olin in Separate Insurance Disputes

Jenner & Block has won two victories for client Olin Corp in insurance disputes relating to environmental cleanup costs at several sites.  Thus far, the two recent awards have exceeded $85 million. In April, US District Judge Thomas P. Griesa ordered OneBeacon American Insurance Co. to pay Olin $80 million in damages and interest for the cleanup of groundwater contamination at four sites across the country, following a lengthy jury trial and several hearings.  Those sites were in Georgia, New York, Ohio and Alabama; the award included $38 million in indemnification costs and $42 million in prejudgment interest.  In May, Judge Griesa awarded Olin $5.4 million in a dispute over a New Jersey site.  The order came after Judge Griesa denied OneBeacon’s request for trial to determine the amount because standard pro rata allocation method applied.  Judge Griesa had already found that OneBeacon owes Olin coverage for the cleanup of the Bridgeport Rental Oil & Services (BROS) Superfund Site in Bridgeport, New Jersey.  The team representing Olin in these disputes with OneBeacon includes Partners Craig C.
