Jenner & Block won a victory for client Precise Systems in a set-aside contract dispute. A service-disabled veteran-owned business, Precise Systems initially won a $134 million State Department aviation support contract that was reserved for service-disabled veteran-owned small businesses. Later, after losing bidders raised concerns with Precise’s Employee Stock Ownership Plan (ESOP), the Small Business Administration deemed Precise ineligible to receive the contract. On Monday, the Court of Federal Claims remanded the decision, ruling that the SBA did not properly analyze the ESOP’s impact on the ownership and control of the business.
