Jenner & Block won a victory for client AOL Inc. when a Texas appeals court dismissed defamation claims against AOL and a reporter. A Dallas-area dentist sued AOL and a reporter over a 2012 article that, the dentist claimed, falsely represented that he had been criminally charged with Medicaid fraud. At the time, the dentist was embroiled in a series of lawsuits accusing him of civil Medicaid fraud violations. The Fifth Circuit Court of Appeals found that the article was protected under the Texas Citizens Participation Act and that the dentist had not shown it was defamatory. News of the dismissal was covered in Law360. Partner Jessica Ring Amunson argued the case to the Texas court of appeals in January. Partner Michael B. DeSanctis, Associate Rochelle P. Lundy, Paralegal Cheryl Olson and Legal Secretary Sheree Anyiam assisted with the appellate briefing.
