Partners Lindsay C. Harrison and Paul M. Smith, Associate R. Trent McCotter and Law Clerk Nicholas Tarasen are working with Lambda Legal on behalf of three same-sex couples seeking the right to marry in West Virginia.  In addition, they represent one child of a same-sex couple suing for the right of his parents to marry in West Virginia.  On January 29, 2014, the U.S. District Court for the Southern District of West Virginia denied the Defendant County Clerks’ motion to dismiss and ruled that the Plaintiffs will be allowed to proceed with their case.  In the lawsuit, the Plaintiffs argue that West Virginia’s marriage ban unfairly discriminates against same-sex couples and their childrenand deprives them of the fundamental right to marry.
