Firm Wins Preliminary Injunction for Fox in Longstanding Copyright Infringement Dispute

Jenner & Block earned an important victory for firm client Fox Broadcasting Company, as well as for local Utah Fox, CBS and MyNetwork stations, after a U.S. District Court judge in Utah granted a preliminary injunction that blocks online streaming service Aereo from rebroadcasting Fox’s and the other broadcasters’ copyrighted content within the geographic reach of the 10th Circuit—Colorado, Utah, New Mexico, Oklahoma, Kansas and Wyoming.  The Jenner & Block team led by Partner Richard L. Stone contends that Aereo is retransmitting online the valuable content created by broadcasters without their permission and without paying a fee. This matter, Community Television of Utah, et al. v. Aereo, Inc., is part of a larger ongoing copyright infringement battle that threatens the current over-the-air broadcasting business model.  

Jenner & Block sought a preliminary injunction on behalf of its clients, and Aereo sought to have the case transferred to the Southern District of New York or stayed, without decision on the preliminary injunction, pending the U.S. Supreme Court’s decision in the related case ABC v.
