Firm’s Appellate Victory for New York City in Pollution Litigation Stands

Jenner & Block won another victory for client New York City in long-running litigation against Exxon Mobil.  The litigation focused on Exxon’s contamination of City-owned wells with a gasoline additive known as methyl tertiary butyl ether (MTBE).  In 2009, a jury awarded the City $105 million in compensatory damages; in July 2013, the Second Circuit upheld that verdict.  On October 15, 2013, the appeals court denied Exxon’s petition for a panel rehearing or a rehearing en banc.  The firm team representing New York includes Partners Marc A.
