Jenner & Block won a victory for Nabisco’s parent company when a judge threw out a proposed class action suit that alleged false advertising.  At issue were Nabisco’s fruit Newton cookies, which the plaintiff alleged are advertised as containing “real fruit” when in fact they are made with fruit puree.  Partners Kenneth K. Lee and Dean N. Panos and Associate L. David Russell sought a motion to dismiss for client Mondelez International Inc.; a California federal judge granted it on September 27, 2013, calling the claims “ridiculous.” News of the dismissal was covered by Law360 and The Food Identity Blog.
