“Vigorously Litigating the Employment Trade Secrets Case,” American Conference Institute's National Conference on Employment Trade Secrets, Chicago, IL

Jenner & Block Partner Debbie L Berman will speak at American Conference Institute’s National Conference on Employment Trade Secrets on May 27-28, 2009 in Chicago. The program will focus on enforcing and drafting noncompete provisions and protecting company trade secrets.

Ms. Berman will speak on the panel titled “Vigorously Litigating the Employment Trade Secrets Case.” This panel will address the following topics on employment trade secrets litigation: framing the strongest legal analysis; specific steps to building an effective case; proving the case through electronic misappropriation; maintaining security of information during the litigation; incorporating relevant employment law analysis; overcoming the challenges of inevitable disclosure in trade secrets litigation; factors to consider in evaluation whether to settle the case; jury considerations at trial; and securing permanent injunctions.

Ms. Berman is a member of the Firm’s Litigation Department and has substantial experience representing clients in trade secrets and unfair competition matters.  She litigated the seminal case involving the inevitable disclosure doctrine for trade secrets, Pepsico v. Redmond, 54 F.3d 1262 (7th Cir. 1995), both on the trial and appellate level.  In addition, she has represented other clients in preliminary injunction and other proceedings concerning the enforcement of covenants not to compete and related trade secrets issues, and in Lanham Act and other unfair competition litigation.  She also counsels clients on trade secrets and unfair competition issues in non- and pre-litigation settings, including assisting clients in developing policies for protecting their trade secrets.
