“Resolving Difficult D&O Claims with Multiple Layers: What Happens When the Primary Layer Pays Less Than Limits?,” 5th Annual National Directors and Officers Insurance ExecuSummit, Uncasville, CT

Jenner & Block Partner Matthew L. Jacobs will speak at the 5th Annual National D&O Insurance ExecuSummit to be held May 19-20 at the Mohegan Sun Resort, Casino & Spa in Uncasville, CT. 

Mr. Jacobs will speak at a session titled, “Resolving Difficult D&O Claims with Multiple Layers: What Happens When the Primary Layer Pays Less Than Limits?”  and will discuss “exhaustion of underlying limits” provisions in excess D&O policies that are holding up the settlement of large D&O claims, leading to mediation and arbitration, and have “resulted in the break down of good will among insureds and insurers.”  The presentation,“A New Challenge in Climbing the Tower of Coverage: Comerica, Qualcomm, Zeig and the Exhaustion of Underlying Limits,” discusses the Comerica/Qualcomm cases. 

Mr. Jacobs is a member of the Firm’s Insurance Litigation and Counseling and Reinsurance Practices.  He is responsible for complex, multi-party insurance coverage litigation matters in state and federal courts, and he regularly advises corporations on the availability of insurance coverage for a wide variety of claims, including those related to directors and officers liability, errors and omissions, mortgage lending practices, mold and water damage, business interruption losses, product liability, mutual fund late-trading and market timing lawsuits and regulatory investigations and environmental matters.  Mr. Jacobs has written extensively on issues of insurance coverage for D&O liabilities and related matters, has spoken at over 75 conferences, and has chaired over a dozen more, both domestically and internationally, in the past 20 years on various insurance coverage issues.
