Jenner & Block Partner Ian Heath Gershengorn will discuss the ways in which Equal Protection is being used to attack Indian Law, in contexts as diverse as the Indian Child Welfare Act, the Indian Gaming Regulatory Act, and attempts to overturn the US Supreme Court’s McGirt decision. He and other panelists will situate these Equal Protection challenges within the broader framework of constitutional challenges to Indian Law. Finally, the panelists will give practitioners tools they need to push back against these arguments.

Mr. Gershengorn is chair of the firm’s Appellate and Supreme Court Practice and a partner in the firm’s Native American Law Practice. In 2020, he successfully argued before the US Supreme Court on behalf of pro bono client Jimcy McGirt in McGirt v. Oklahoma; the Court held that the Muscogee (Creek) Nation’s federal reservation endures—which meant that the state lacked jurisdiction to prosecute Mr. McGirt.
