On August 12, Jenner & Block Partners Mark Davis and Ronald J. Pabis and Associate Susan A. O’Brien will present a CLE webinar on life science-related investigations at the US International Trade Commission (ITC). Partner Louis E. Fogel will moderate the discussion. The program will examine the use of ITC Section 337 investigations for life sciences products, including pharmaceuticals and medical devices. The presenters will cover important issues arising in such cases, including the use of public interest factors, indirect infringement, design around alternatives, the substantive elements of proof, and the procedure used by the ITC in these types of investigations. Mr. Davis is co-chair of the ITC Section 337 Practice. He represents multinational, domestic, and start-up companies regarding intellectual property and related international trade, data privacy, unfair competition, and antitrust matters. He has litigated disputes before US district courts throughout the country and the Court of Appeals for the Federal Circuit and has been involved in more than 100 section 337 investigations before the ITC.

Mr. Fogel is co-chair of the Life Sciences Practice and a member of the Patent Litigation and Counseling Practice. He represents clients on a range of intellectual property matters, with an emphasis on patent and trade secret litigation. Mr. Fogel’s litigation experience spans a wide array of technologies and industries, including biological drugs, pharmaceuticals, medical devices, chemicals, consumer electronics, and telecommunications.

Mr. Pabis is co-chair of the ITC Section 337 Practice. He represents technology companies in patent litigation and patent licensing disputes at all stages of the litigation process. In addition, he has handled and tried a number of Section 337 investigation hearings before the ITC.

Ms. O’Brien is an associate in the firm’s Litigation Department and the Patent Litigation and Counseling Practice.
