On March 21, Partner John H. Mathias, Jr. discussed the perceived fairness of modern US insurance and reinsurance arbitrations at the IBA Insurance Conference. In the written materials accompanying the presentation, Mr. Mathias and Associate Catherine L. Doyle examined the arbitrator and umpire selection process, the rules involved and the ethical issues that arise. To conclude, they advocated for a re-examination of the arbitration process, citing that neutral arbitrators would incentivize justice over anything else.
Mr. Mathias is a senior litigation partner and veteran trial lawyer. He is co-chair of the firm’s Insurance Recovery and Counseling Practice and oversees its Reinsurance Practice.
