“Sections 371 and 7212(a) – Life After Marinello,” American Bar Association’s Combined Annual National Institutes on Criminal Tax Fraud and Tax Controversy

Jenner & Block Partner Geoffrey M. Davis presented on a panel that discussed future and collateral implications of the US Supreme Court’s March 2018 ruling in United States v. Marinello concerning the scope of felony tax obstruction.  Mr. Davis, who co-chairs the firm’s Tax Practice, provided tax controversy counsel for defendant Carlo Marinello in the case. After fellow Jenner & Block Partner Matthew S. Hellman argued the case in front of the high court, the justices ruled 7-2 in favor of the firm’s client.  The ruling overturned the client’s tax obstruction conviction and, in the process, overturned the settled precedent of six lower circuit courts of appeal.
