Jenner & Block Partners Neil M. Barofsky and Carter H. Klein and Associate Anna Barreiro Sutti will speak at a Letter of Credit Law Summit hosted by the firm’s New York office.  On October 27, 2016, Mr. Klein will discuss whether “strict compliance” has meaning in LC practice, in a session titled “The Myth of Strict Compliance.”  Also on October 27, Ms. Sutti will speak about syndicated loans and LCs.  On October 28, Mr. Barofsky will discuss the US Treasury’s proposed rule requiring banks to get information about owners of shell company bank accounts, in a session titled “US Treasury Takes a Stand for Transparency.” 

Mr. Barofsky focuses his practice on compliance counseling,  monitorships, white collar investigations, complex commercial litigation and financial institutions litigation.  He is the appointed monitor to Credit Suisse AG following the bank’s $715 million settlement with the New York Department of Financial Services, part of a broader $2.6 billion settlement that involved the U.S. Department of Justice and federal regulators.  In 2015, he was named one of The National Law Journal’s “Winning” litigators.  He was also recognized by The National Law Journal as a “Trailblazer” in the regulatory and compliance area.

Mr. Klein concentrates on Uniform Commercial Code work, secured and unsecured lending, asset sales and purchases, trade finance, outsourcing, payments, financial services and regulation and credit enhancements and workouts. Corporations, businesses, banks and other financial institutions seek his counsel on funds transfers, sales and acquisitions, and financial and international transactions work. In particular, he has extensive experience with Article 5 of the Uniform Commercial Code – Letters of Credit.

Ms. Sutti focuses her practice on Corporate Finance transactions. Ms. Sutti has counseled public and private companies, financial institutions, and private equity funds in a variety of Corporate Finance transactions.  She has substantial experience with senior secured financings, subordinated loans, second lien loans, mezzanine financings and unsecured loans.  She has also represented clients in commercial credit card programs and in connection with treasury management agreements.
