“Employee Severance Under Attack: The Courts’ Latest Rulings, Crafting and Negotiating Enforceable Release and Pay Provisions,” Strafford Publications Teleconference

Jenner & Block Partner S. Tony Ling spoke on a Strafford Publications Teleconference entitled, “Employee Severance Under Attack: The Courts’ Latest Rulings, Crafting and Negotiating Enforceable Release and Pay Provisions,” on January 16.

The teleconference highlighted recent court decisions focusing on the legality of release agreements in severance contracts, and how they have caused employers to re-examine their practices regarding severance packages.

The focus of Mr. Ling’s discussion was the impact the 409A final rules, which go into effect January 1, 2009, will have on severance agreements.  He provided details and examples of the new 409A rules so that the listeners could familiarize themselves with the issues that they may face when preparing and negotiating severance arrangements. 

Mr. Ling was joined on the panel by Ian D. Meklinsky, Partner, Fox Rothschild, Princeton, New Jersey; and Barbara Jean D’Aquila, Partner, Fulbright & Jaworski, Minneapolis, Minnesota.
