Jenner & Block Partner Matthew L. Jacobs will speak on a panel titled, “Claims Processing - Special Considerations for the Various Parties” at the HB Litigation Conference “Chinese Drywall Litigation and Insurance Coverage Update” in New Orleans, Louisiana on November 11. Mr. Jacobs will talk about whether there is a legal obligation if homebuilders seek to mitigate existing damages and prevent further damages. He will also discuss how to allocate damages across multiple-parties, specifically, whose policy will likely provide coverage and which policies to place on notice. Mr. Jacobs also will address consideration of the “voluntary payments” condition and the “no action” condition.
Mr. Jacobs is a member of the Firm’s Insurance Litigation and Counseling and Reinsurance Practices. He regularly advises corporations on the availability of insurance coverage for a wide variety of claims, including those related to directors and officers liability, errors and omissions, mortgage lending practices, mold and water damage, business interruption losses, product liability, mutual fund late-trading and market timing lawsuits and regulatory investigations and environmental matters. Mr. Jacobs has written extensively on issues of insurance coverage for D&O liabilities and related matters, has spoken at over 100 conferences, and has chaired over a dozen more, both domestically and internationally, in the past 25 years on various insurance coverage issues.
