Jenner & Block Of Counsel Richard P. Campbell and Partner Sandi J. Toll recently presented a Blue Plan Legal Department Cooperative 2012 National Teleconference Series webinarto 165 Blue Plan attorneys  titled “Ethical Considerations and the Advice of Counsel Defense,” held on June 14.  The presentation was inspired by increased litigation in the health care industry, as well as in the number of individuals and companies relying upon the advice of counsel defense to avoid civil, criminal, and administrative penalties.  The presentation addressed the advantages and drawbacks of asserting an advice of counsel defense, privilege and waiver considerations, the scope of in-house counsel’s obligations to both the company and outside counsel, and best practices for in-house counsel going forward.

Mr. Campbell is a member of the Firm’s Antitrust Litigation and Labor Employment Practices.  Mr. Campbell has been named a 2012 Best Lawyer in America in Antitrust Litigation. He is also AV Peer Review Rated, Martindale-Hubbell’s highest peer recognition for ethical standards and legal ability.

Ms. Toll is a litigator who focuses her practice primarily on complex commercial litigation matters involving breach of contract and other business disputes in both federal and state court.  She also conducts large internal investigations for individual and corporate clients facing allegations of wrongdoing or seeking to address compliance concerns.  Clients also seek her counsel in a variety of health care matters, including civil and criminal matters, government investigations, and in defense of False Claims Act (qui tam) matters.
